| The Federal Highway Administration (FHWA), Federal Railroad Administration (FRA), and FTA have released updated guidance for project sponsors involved in surface transportation projects. The Section 139 Efficient Environmental Reviews for Project Decisionmaking and One Federal Decision Interim Final Guidance provides essential information regarding the statutory framework outlined in 23 U.S.C. 139 that governs the agencies' environmental review processes; it is effective immediately. This Interim Final Guidance reflects numerous statutory changes made by MAP-21 (2012), the FAST Act (2015), and the Bipartisan Infrastructure Law (2021); it supersedes and replaces the previous guidance, the SAFETEA-LU (2006) Environmental Review Process Final Guidance jointly issued by FHWA and FTA. To provide comments on the Interim Final Guidance, visit the regulations.gov docket and the agencies' websites. The agencies will consider any feedback and may incorporate it into the final guidance.
